Terms of Service

These Terms of Service govern your access to and use of the 3DIO World website and your purchase of products from 3DIO World.

The store is operated by Figtiin Pte Ltd, a company incorporated in Singapore, trading as 3DIO World (“3DIO World”, “we”, “us” or “our”).

By visiting the store, placing an order, downloading a digital product or otherwise using our services, you agree to be bound by these Terms of Service and the policies referred to in them.

Please read these Terms of Service carefully before making a purchase.

1. Our Store

3DIO World sells products through an online store hosted by Shopify.

Any contract for the purchase of a product from 3DIO World is entered into directly between you and Figtiin Pte Ltd. Shopify provides the ecommerce platform but is not the seller of products purchased from our store.

These Terms of Service apply together with our:

  • Return and Refund Policy;

  • Shipping Policy;

  • Privacy Policy;

  • Product-specific terms;

  • Licence terms for digital products; and

  • Any other policies or instructions displayed on the store.

Where product-specific terms are displayed on a product page, those terms form part of your agreement with us.

2. Eligibility to Purchase

You must be legally capable of entering into a binding contract to place an order.

By placing an order, you confirm that:

  • You are of the legal age required to enter into a contract in your jurisdiction; or

  • You are placing the order with the involvement and permission of a parent or legal guardian.

You must not use the store or purchase products for any unlawful, fraudulent or unauthorised purpose.

3. Product Categories

These Terms of Service apply to:

  • Ready-stock physical products;

  • Pre-order products;

  • Custom-made or personalised products;

  • Digital products and downloads; and

  • Any related products or services offered through the store.

Additional conditions applying to a particular product category are set out below.

4. Product Information

We make reasonable efforts to describe and display our products accurately.

Product descriptions may include information concerning:

  • Materials;

  • Dimensions;

  • Features;

  • Compatibility;

  • Lighting or electrical components;

  • Assembly requirements;

  • Manufacturing methods;

  • Intended use;

  • Included accessories; and

  • Estimated production or fulfilment periods.

You are responsible for reviewing the complete product description before placing an order.

Unless expressly stated otherwise, display figures, collectibles, decorative accessories and other objects shown in product photographs are used for illustration and are not included with the product.

5. Product Images and Colour Representation

Product images are intended to provide a reasonable representation of the product.

However, the appearance of a product may vary because of:

  • Screen calibration and display settings;

  • Lighting conditions;

  • Photography and image processing;

  • Material batches;

  • Manufacturing tolerances;

  • Hand-finishing;

  • Assembly methods; and

  • 3D-printing processes.

Minor differences in colour, texture, layer lines, seams, finish, dimensions or handmade details that do not materially affect the product’s intended function are not considered defects.

Images, visualisations, renders, mock-ups and prototypes may be used to illustrate products that are still in development or available for pre-order. The final product may contain reasonable design or manufacturing refinements.

We will not make a material change that substantially alters the essential nature of the product without providing appropriate notice or a remedy where required by law.

6. Orders and Contract Formation

Submitting an order constitutes an offer to purchase the selected products under these Terms of Service.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that we have accepted the order.

A contract is formed when we take one of the following actions:

  • Confirm that the order has been accepted;

  • Begin producing a custom-made product;

  • Accept and process a pre-order;

  • Dispatch a physical product;

  • Make a digital product available for download or access; or

  • Otherwise expressly confirm acceptance.

We may decline or cancel an order before acceptance for reasons including:

  • Product unavailability;

  • Incorrect pricing or product information;

  • Suspected fraud or unauthorised payment;

  • Payment verification failure;

  • Shipping restrictions;

  • Legal or regulatory restrictions;

  • Suspected resale or misuse;

  • Errors in the order;

  • Inability to complete a custom request; or

  • Events outside our reasonable control.

If we decline or cancel an order after payment has been collected, we will refund the applicable amount paid for the cancelled item.

7. Order Information

You must provide complete and accurate information when placing an order, including your:

  • Name;

  • Email address;

  • Telephone number;

  • Billing information;

  • Delivery address; and

  • Any information required for a custom-made product.

You are responsible for checking this information before completing checkout.

Contact us promptly at support@3dio.world if you discover an error. We cannot guarantee that an order can be changed after it has been submitted.

You are responsible for additional expenses caused by inaccurate or incomplete information, including reshipping charges, address-correction fees and customs expenses, except where the error was caused by us.

8. Prices

Product prices are displayed in the currency selected or shown on the store.

Prices may change at any time without notice. A price change will not normally affect an order that we have already accepted.

Unless stated otherwise, product prices do not include:

  • International customs duties;

  • Import taxes;

  • Brokerage charges;

  • Local handling charges;

  • Foreign transaction fees; or

  • Other charges imposed by a destination country, financial institution or third party.

Any applicable shipping charges and taxes collected by us will be displayed during checkout.

We do not guarantee retrospective price adjustments when a product is subsequently discounted or included in a promotion.

9. Pricing and Listing Errors

We may correct typographical errors, inaccurate descriptions, incorrect prices, incorrect availability information or other listing mistakes at any time.

If an obvious pricing or listing error affects your order, we may:

  • Contact you for instructions;

  • Offer the product at the correct price;

  • Correct the order with your agreement; or

  • Cancel the affected item and refund the amount paid.

We are not required to fulfil an order at a price that is clearly erroneous, subject to applicable law.

10. Payment

Full payment is required at checkout.

Available payment methods are displayed during checkout and may be provided by Shopify or third-party payment providers.

By submitting payment information, you confirm that:

  • You are authorised to use the selected payment method;

  • The payment information is complete and accurate;

  • You authorise the applicable charges; and

  • The transaction does not violate any law or third-party right.

Your payment provider may perform authentication, fraud screening or verification before approving the transaction.

We may suspend or cancel an order where payment is declined, reversed, disputed or identified as potentially unauthorised.

11. Promotions and Discount Codes

Promotions and discount codes are subject to their stated conditions.

Unless expressly stated otherwise:

  • Promotions cannot be combined;

  • Discount codes have no cash value;

  • Discounts cannot be applied retrospectively;

  • A discount applies only during its stated validity period;

  • Eligibility requirements must be satisfied at checkout; and

  • We may withdraw or correct a promotion affected by an error, misuse or fraud.

Products returned, refunded or removed from an order may affect the order’s eligibility for a promotion. Any refund may be adjusted to reflect the promotional value actually received.

12. Ready-Stock Products

A ready-stock designation means that the product is expected to be available when listed.

It does not guarantee availability until the order has been accepted.

Occasionally, stock information may be inaccurate because of simultaneous purchases, inventory errors, damage discovered during inspection or another unexpected issue.

Where a ready-stock product cannot be supplied, we may offer:

  • A revised fulfilment date;

  • An alternative product;

  • Store credit; or

  • A refund for the unavailable item.

You will not be required to accept an alternative product or store credit where a refund is legally required.

13. Pre-Order Products

A pre-order allows you to purchase a product before it is ready for immediate dispatch.

Full payment for a pre-order is collected at checkout.

Any production, arrival, release or dispatch date displayed for a pre-order is an estimate unless expressly stated to be guaranteed.

Estimated dates may change because of:

  • Product development;

  • Manufacturing;

  • Supplier delays;

  • Quality-control requirements;

  • Component availability;

  • Shipping disruptions;

  • Customs clearance;

  • Regulatory requirements; or

  • Events outside our reasonable control.

A change to an estimated date does not automatically entitle you to cancel the pre-order, except where required by applicable law or expressly offered by us.

We may make reasonable refinements to the design, materials, construction, packaging or specifications of a pre-order product. Any change will not intentionally alter the product’s essential character or materially reduce its intended functionality.

If we determine that a pre-order cannot be fulfilled, we will cancel the affected item and refund the amount paid for it.

When ready-stock and pre-order products are purchased in the same order, they may be shipped together or separately. The applicable fulfilment arrangement may be explained on the product page, at checkout or in the Shipping Policy.

14. Custom-Made and Personalised Products

Custom-made products are produced, modified or personalised according to information supplied or approved by you.

You are responsible for ensuring that all submitted information is accurate, including:

  • Names;

  • Text;

  • Measurements;

  • Colours;

  • Specifications;

  • Images;

  • Reference files;

  • Compatibility information; and

  • Design instructions.

Once an order has been submitted, changes are not guaranteed.

Where we agree to a change, additional charges or a revised production period may apply.

If a design proof or confirmation is provided, you must review it carefully. Your approval authorises us to proceed based on the approved version.

Delays in providing information or approving a proof may delay production and delivery.

Custom-made products may contain reasonable variations arising from material characteristics, manufacturing, hand-finishing or 3D printing.

Custom-made and personalised products cannot be returned, exchanged or cancelled because of a change of mind, an incorrect customer-supplied instruction or dissatisfaction with an approved design, except where required by applicable law.

You confirm that you have the necessary rights and permission to provide any name, image, logo, artwork, design, trademark or other material submitted for customisation.

We may reject customisation requests that we reasonably believe:

  • Infringe intellectual-property rights;

  • Violate a law;

  • Are defamatory, hateful, obscene or threatening;

  • Contain unlawful or prohibited content;

  • Create safety concerns; or

  • Are technically unsuitable for production.

15. Digital Products and Downloads

Digital products may include:

  • Digital artwork;

  • Design files;

  • 3D models;

  • Printable files;

  • Instructions;

  • Templates;

  • Documents;

  • Software-related files; and

  • Other downloadable content.

A purchase of a digital product gives you a licence to use the digital content. It does not transfer ownership of the copyright or other intellectual-property rights.

Unless a product page expressly grants a different licence, digital products are licensed to you on a:

  • Personal;

  • Non-exclusive;

  • Non-transferable;

  • Non-sublicensable; and

  • Revocable basis.

You may download and use the product for your own personal, non-commercial purposes.

Where the product is a 3D-printable file, you may produce physical copies for your own personal use unless the product page states otherwise.

Without a separate commercial licence, you must not:

  • Resell or redistribute the digital file;

  • Share the file with another person;

  • Upload the file to a public or shared platform;

  • Sublicense the file;

  • Claim the file or design as your own;

  • Convert or modify the file for resale;

  • Use the file to manufacture products for sale;

  • Sell physical products made from the file;

  • Include the file in another product or collection;

  • Remove copyright, trademark or ownership notices; or

  • Use the file in a way that infringes another party’s rights.

Digital products are considered supplied when the download, access link or digital content is made available to you.

Because digital products cannot be physically returned, purchases are final once access or download has been provided, except where:

  • The file is materially corrupted or unusable;

  • We supplied the wrong digital product;

  • We are unable to provide access; or

  • A refund or other remedy is required by applicable law.

You must contact support@3dio.world if you experience a technical problem with a digital product. We may first attempt to repair, replace or reissue the file.

You are responsible for confirming that your hardware, software and file-format requirements are compatible with the digital product before purchasing it.

16. Order Changes and Cancellations

All confirmed orders are final.

We do not guarantee that an order can be cancelled or modified after it has been placed.

This applies particularly to:

  • Custom-made products;

  • Personalised products;

  • Products already in production;

  • Pre-order allocations;

  • Digital products that have been delivered or accessed; and

  • Physical products that have entered fulfilment.

Contacting us with a cancellation request does not mean the request has been accepted.

Nothing in this section limits a cancellation or withdrawal right that cannot legally be excluded.

17. Shipping and Delivery

Shipping methods, estimated fulfilment periods and other delivery conditions are governed by our Shipping Policy and any information displayed during checkout.

Delivery dates are estimates unless we expressly confirm otherwise.

We are not responsible for delays caused by:

  • Couriers or postal operators;

  • Customs authorities;

  • Incorrect delivery information;

  • Failed delivery attempts;

  • Import restrictions;

  • Weather;

  • Transport disruption;

  • Labour disputes;

  • Public emergencies; or

  • Events outside our reasonable control.

We may contact you where additional information is required to fulfil or deliver an order.

18. Customs, Duties and Import Restrictions

You are responsible for checking whether a product may lawfully be imported, possessed or used in your destination country.

Unless checkout expressly states that duties and taxes are included, you are responsible for:

  • Customs duties;

  • Import taxes;

  • Brokerage charges;

  • Inspection fees;

  • Local handling fees; and

  • Similar destination charges.

A refusal to pay customs charges does not automatically entitle you to a refund.

If a parcel is refused, abandoned, destroyed, returned or held by customs, any refund will be assessed after considering:

  • Whether the parcel is returned to us;

  • Its condition;

  • Non-refundable shipping expenses;

  • Customs charges;

  • Return transportation costs; and

  • Applicable consumer law.

19. Risk and Ownership

Ownership of a physical product passes to you only after we have received full payment.

Risk of loss or damage passes to you when the product is delivered to:

  • The delivery address provided with the order;

  • A person accepting the parcel at that address;

  • A location authorised by you; or

  • A collection point selected or authorised by you,

subject to any rights that cannot be excluded under applicable law.

Purchasing a digital product grants only the applicable licence. Ownership of the underlying intellectual property does not transfer to you.

20. Returns, Refunds and Defective Products

All sales are final, and we do not accept returns or exchanges for change of mind.

Damaged or defective physical products are handled under our Return and Refund Policy.

A damaged or defective item must be reported to support@3dio.world within three calendar days of the carrier marking the item as delivered.

A claim must include the evidence requested in the Return and Refund Policy, including:

  • A continuous unboxing video;

  • Clear photographs of the product; and

  • Clear photographs of the external and internal packaging.

Our first resolution for an approved claim will ordinarily be a replacement.

We will cover the reasonable shipping cost of an approved replacement.

A refund may be provided where a replacement is unavailable or cannot reasonably be supplied. An approved refund for a damaged or defective item will include the applicable delivery fee, in accordance with our Return and Refund Policy.

Do not return a product unless instructed to do so. A return is required only when requested by us.

Nothing in these Terms of Service excludes or restricts a statutory guarantee, remedy or consumer right that cannot legally be excluded.

21. Product Use and Safety

You must use products only:

  • For their intended purpose;

  • In accordance with the product description;

  • In accordance with supplied instructions;

  • With suitable equipment and power sources; and

  • In a safe and responsible manner.

Where a product is described as a collectible, miniature environment or display accessory, it is intended for display use and should not be treated as a toy unless the product page expressly states otherwise.

Products may contain small parts, magnets, lighting, wires, electronic components or other elements unsuitable for young children.

You are responsible for keeping products away from children, pets, heat, water and other unsuitable conditions where appropriate.

You must not modify, connect, install or operate an electrical product in a manner inconsistent with its instructions or specifications.

We are not responsible for damage caused by:

  • Misuse;

  • Mishandling;

  • Incorrect installation;

  • Unauthorised modification;

  • Incorrect voltage or power supply;

  • Use with incompatible products;

  • Failure to follow instructions;

  • Normal wear and tear; or

  • Use for an unintended purpose.

This does not exclude liability that cannot lawfully be excluded.

22. Compatibility

Any compatibility information is based on the product specifications and information reasonably available to us.

You are responsible for checking measurements, clearances, power requirements, scale and other compatibility information before purchasing.

References to third-party figures, collectibles, brands or products may be used solely to describe scale, fit, compatibility or intended display use.

Unless expressly stated otherwise, Figtiin Pte Ltd and 3DIO World are not affiliated with, sponsored by, authorised by or endorsed by the owners of those third-party products or intellectual-property rights.

All third-party names, trademarks, characters and product names remain the property of their respective owners.

23. Accounts and Account Security

Some store features may allow or require you to create an account.

You are responsible for:

  • Providing accurate account information;

  • Maintaining the confidentiality of your password;

  • Restricting access to your device;

  • Informing us of suspected unauthorised activity; and

  • All actions taken through your account.

We may suspend or terminate an account that is used fraudulently, unlawfully or in breach of these Terms of Service.

24. Acceptable Use

You must not use the store, its content or its services to:

  • Violate any law or regulation;

  • Infringe intellectual-property rights;

  • Submit false or misleading information;

  • Commit fraud;

  • Transmit malicious code;

  • Attempt unauthorised access;

  • Scrape or harvest data without permission;

  • Interfere with the store’s security or operation;

  • Impersonate another person;

  • Submit unlawful, abusive or harmful material;

  • Circumvent purchase limits;

  • Misuse promotions or discount codes; or

  • Resell products in violation of an expressly stated restriction.

We may restrict access, cancel orders or take other reasonable action where we suspect prohibited activity.

25. Intellectual Property

The store and its contents are owned by or licensed to Figtiin Pte Ltd.

Protected content may include:

  • The 3DIO World name and branding;

  • Logos;

  • Product designs;

  • Diorama designs;

  • Photographs;

  • Videos;

  • Graphics;

  • Illustrations;

  • Product descriptions;

  • Website copy;

  • Digital files;

  • 3D models;

  • Instructions;

  • Packaging;

  • Software; and

  • Store layout.

You may view the store and retain ordinary purchase records for personal use.

You must not copy, reproduce, republish, distribute, sell, modify, reverse engineer, create derivative works from or commercially exploit protected content without prior written permission.

No licence is granted except as expressly stated in these Terms of Service or on a product page.

26. Reviews, Feedback and Submitted Content

Where you submit a review, photograph, suggestion, comment or other content, you confirm that:

  • You created it or have permission to submit it;

  • It is accurate to the best of your knowledge;

  • It does not infringe another party’s rights;

  • It does not contain unlawful or harmful material; and

  • Its submission does not breach a confidentiality obligation.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and adapt the submitted content for operating, improving and promoting the store and our products.

We may remove submitted content that violates these Terms of Service or applicable law.

We are not required to keep unsolicited ideas or suggestions confidential.

27. Privacy

Our collection, use, disclosure and protection of personal data are described in our Privacy Policy.

By using the store, you acknowledge that personal data may be processed by Figtiin Pte Ltd, Shopify, payment providers, couriers and other service providers necessary to operate the store and complete your order.

28. Third-Party Services and Links

The store may use or link to third-party services, including:

  • Shopify;

  • Payment providers;

  • Shipping providers;

  • Social media platforms;

  • Embedded content;

  • Apps; and

  • External websites.

Third-party services are governed by their own terms and privacy practices.

We are not responsible for the content, availability, security or practices of an independent third-party service, except to the extent responsibility cannot lawfully be excluded.

29. Store Availability

We aim to keep the store available and functioning properly but do not guarantee uninterrupted or error-free access.

We may suspend, modify or discontinue any part of the store for:

  • Maintenance;

  • Security;

  • Technical changes;

  • Legal compliance;

  • Platform changes; or

  • Business reasons.

Where reasonably possible, changes affecting an accepted order will be handled in accordance with these Terms of Service and applicable law.

30. Disclaimer of Warranties

To the maximum extent permitted by law, the store and its general informational content are provided on an “as available” basis.

We do not guarantee that:

  • The store will always be uninterrupted;

  • Every error will be corrected immediately;

  • The store will be free from all harmful components;

  • A product will be suitable for an unstated purpose; or

  • Results obtained from using a product will meet subjective expectations.

Any product warranty expressly provided on a product page applies according to its stated conditions.

Nothing in these Terms of Service excludes an express promise made by us or a warranty, statutory guarantee or consumer right that cannot legally be excluded.

31. Limitation of Liability

To the maximum extent permitted by law, Figtiin Pte Ltd and 3DIO World will not be liable for indirect, incidental, special or consequential losses arising from your use of the store or a product, including:

  • Loss of profits;

  • Loss of revenue;

  • Loss of business;

  • Loss of opportunity;

  • Loss of data; or

  • Reputational loss.

Where our liability can lawfully be limited, our total aggregate liability arising from an affected order will not exceed the amount you paid to us for that order.

Nothing in these Terms of Service excludes or limits liability for:

  • Death or personal injury where liability cannot legally be excluded;

  • Fraud or fraudulent misrepresentation;

  • Wilful misconduct;

  • A breach of an obligation that cannot legally be excluded; or

  • A mandatory consumer remedy.

32. Responsibility for Your Conduct

To the extent permitted by law, you are responsible for losses, claims, costs or liabilities arising from:

  • Your unlawful use of the store;

  • Your misuse or unauthorised modification of a product;

  • Material you submit for customisation;

  • Your infringement of another person’s intellectual-property rights; or

  • Your material breach of these Terms of Service.

This section does not require a consumer to compensate us for a loss that was caused by our own breach, negligence or unlawful conduct.

33. Events Outside Our Control

We are not responsible for a delay or failure caused by an event outside our reasonable control, including:

  • Natural disasters;

  • Fire or flood;

  • Epidemics or public-health emergencies;

  • War, terrorism or civil disorder;

  • Government action;

  • Customs restrictions;

  • Labour disputes;

  • Transportation disruption;

  • Power or internet failure;

  • Cyberattacks;

  • Supplier failure;

  • Material shortages; or

  • Courier disruption.

We will take reasonable steps to minimise the effects of the event and resume performance when reasonably possible.

If fulfilment becomes impossible, we may cancel the affected part of an order and provide an appropriate refund.

34. Suspension and Termination

We may suspend or terminate your access to the store where you materially breach these Terms of Service, engage in unlawful conduct or create a security risk.

Termination does not affect:

  • Rights and obligations that arose before termination;

  • Payment obligations;

  • Intellectual-property rights;

  • Digital-product licence restrictions;

  • Liability provisions; or

  • Any provision intended to continue after termination.

35. No Waiver

A delay or failure by us to enforce a provision does not waive our right to enforce it later.

A waiver is effective only where clearly communicated by an authorised representative of Figtiin Pte Ltd.

36. Severability

If any provision of these Terms of Service is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

37. Assignment

You may not transfer your rights or obligations under these Terms of Service without our written consent.

We may transfer our rights or obligations as part of a merger, restructuring, sale of business or transfer of the 3DIO World operation, provided that doing so does not unlawfully reduce your consumer rights.

38. Third-Party Rights

Unless expressly stated otherwise, a person who is not a party to the agreement between you and Figtiin Pte Ltd has no right to enforce these Terms of Service.

This does not affect any right or remedy available independently under applicable law.

39. Entire Agreement

These Terms of Service, together with the policies and product-specific terms referred to in them, form the entire agreement between you and Figtiin Pte Ltd concerning your use of the store and purchase of products.

They replace earlier discussions, statements or representations concerning the same subject, except for an express product promise or representation that cannot legally be excluded.

40. Governing Law and Jurisdiction

These Terms of Service and any dispute arising from them are governed by the laws of Singapore.

Subject to any mandatory consumer rights that apply in your country of residence, the courts of Singapore will have jurisdiction over disputes relating to these Terms of Service or an order.

Nothing in this section prevents a consumer from relying on mandatory protections or dispute-resolution rights available under the laws of the country in which the consumer resides.

41. Electronic Communications

You agree that orders, notices, invoices, policies and other communications may be provided electronically.

Electronic communications may be sent to the email address supplied with your order or made available through the store.

You are responsible for maintaining an active email address and checking order communications.

42. Changes to These Terms

We may update these Terms of Service to reflect changes to:

  • Our products or operations;

  • Shopify or other service providers;

  • Legal or regulatory requirements;

  • Payment and shipping arrangements; or

  • Store functionality.

The updated version will be published with a revised “Last updated” date.

Changes will not retrospectively remove rights that arose under an order already accepted, unless required by law or agreed with you.
